Residence for self-employed and employed work in Spain: requirements and rights
Both the Residence for self-employed work and Residence for employed work in Spain allow you to reside legally in Spain and work, with similar rights in terms of family inclusion and access to basic services.
Both procedures require the submission of the above-mentioned documentation and an assessment of the job offer (employed) or the activity project (self-employed) in order to obtain the residence and work permit.

What is the residence and self-employment permit?
Residence and self-employment is a temporary permit granted to foreign citizens who do not reside in Spain, allowing them to start and manage an independent economic activity in the country.
This authorisation is regulated by the following corresponding regulations:
- Organic Law 4/2000, of 11 January, on the Rights and Freedoms of Foreigners in Spain and their Social Integration (Articles 25 bis, 36 and 37).
- Regulation of Organic Law 4/2000, approved by Royal Decree 557/2011, of 20 April (articles 103 to 109).

Requirements and necessary documentation:
- Form EX07: Completed and signed.
- Criminal record certificate: Issued by the countries in which you have resided for the last 5 years.
- Proof of payment of the temporary residence fee: Form 790-052.
- Proof of payment of the employer's fee: Form 790-062, the amount of which varies according to the province.
- Recruitment permit: Evaluation of the job offer presented.
- Work contract: You must present both the original and a copy.
- Employment contract: You must present both the original and a copy.
- Project of the activity: Include details of the investment, expected profitability and, if applicable, the jobs to be created.
- Legalisation and translation: All documents must be legalised, apostilled and translated into Spanish or the co-official language of the place of submission.

What is residence to work for others?
Residence to work in Spain allows foreigners to reside and work in Spain as employees of a Spanish company or entity.
To obtain this permit, the employer must offer a job that meets the legal requirements for hiring foreigners. After receiving and accepting the job offer, the foreign worker can apply for this residence.
Benefits of the residence to work as an employee:
- Legal residence in Spain: Provides beneficiaries and their families with the possibility of residing legally in the country and having access to social and health services.
- Work legally: Allows holders to work in Spain under the same conditions as Spanish citizens.
- Mobility within the Schengen Area: Facilitates free movement within the Schengen Area countries without the need for a visa or border controls.
Requirements to be met by the employee:
- Not be a citizen of the European Union.
- Form EX03: Filled in and signed.
- Criminal record certificate: From the countries of residence in the last 5 years.
- Payment of fees: Form 790-052 for temporary residence and Form 790-062 for the employer's fee (amount varies by province).
- Recruitment permit: Evaluation of the job offer submitted.
- Passport or travel document: Full copy valid for at least four months.
- Additional documentation: All documents must be legalised, apostilled and translated into Spanish or the co-official language of the place of submission.
Requirements to be met by the employer:
Individual employer
- A copy of the NIF or NIE must be submitted or consent must be given to verify identity data through the Identity and Residence Data Verification System.
Domestic service
- A copy of the employer's NIF or NIE must be submitted or consent must be given for identity verification.
- The original employment contract must be submitted and a copy stamped by the Foreigners' Office. The stamped copy must be included in the residence and work visa application.
- A copy of the last income tax return must be provided, or a certificate of income from the Tax Administration, or documentation proving financial solvency for the hiring.
Legal entity
- A copy of the company's NIF and of the registered deed of incorporation.
- Document confirming that the signatory has legal representation of the company.
- A copy of the NIF or NIE of the signatory, or consent for identity verification.
- Documentation proving the solvency of the company, such as the company's withholding tax, VAT, or Corporate Tax declarations or a report of the company's working life (VILE) for the last three years.
